LIGHTING IN TUNNEL
"The lighting of the Mount Victoria Tunnel has been in the experimental stage for a very long time indeed," said Mr. J. H. Luxford, S.M., in the Magistrate's Court today. "In view of the present very dangerous conditions and the risk of accidents, one wonders why the lighting has not been carried through," Mr. Luxford added. Mr. H. R. C. Wild, who appeared for a defendant charged with driving without due care and attention in the tunnel, said that his client came out of the bright daylight at the Hataitai end into the experimental arc lights and into the dark area. His client's eyes did not accustom themselves to the sudden change, although the independent evidence was that his client was going at a reasonable speed. The defendant suddenly saw a bicycle in front, swerved to miss it. but came back again too quickly, catching the front of the cycle. The rider suffered minor injuries. Sub-Inspector J. Dempsey, who prosecuted, said that another independent witness said that the lighting was not too good in that part'of the tunnel Mr. Luxford said that he would impose no fine. The defendant was convicted and ordered to pay costs.
