MAYOR V. COUNCILLOR
THE PLAINTIFF NON-SUITED

PAHIATUA, This Day.
Reserved decision has been giv/n by Mr. J. L. Stout, S.M., in a libel action taken by the Mayor of Pahiatua, James Donald Wilson, against a fellow-coun-cillor, Daniel Moriarty, claiming £100 damages, the result of a letter written by the defendant and published in the "Pahiatua Herald," in which Wilson alleged there was an implication of dishonesty and an attack on his character.
The Magistrate held that the plaintiff must be non-suited because no proof had been given in court that Moriarty actually wrote the letter, and further that the expressions used, while being abusive and in bad taste, were not libellous.
Costs were allowed.
