APPEAL DISMISSED (By Telegraph.—Press Association.) AUCKLAND, June 2. The appeal by the Whangarei Racing Club from the decision of the Auckland District Comniitteo in the Princess Star case was dismissed by Messrs. C. W. Tringham, E. L. Hiddiford, and AY. Perry, of Wellington, the appeal judges appointed by the president of the New Zealand Racing Conference. The judgment is as follows:—"In the matter of the appeal of the Whangarei Racing Club against the decision o£ the- Auckland District Committeo in upholding the appeals lodged by W. Scholium (owner), AY. Goscomb (trainer), and G. Grice (rider) of tlio horse Princess Star against their disqualification for six months from April C, 1033, by the Judicial Coinmitteo of the Whangarei Racing Club, which committeo is of opiuion that Princess Star was not run on her merits in the Portland Hack Handicap, and all three were guilty of contravention of rule 295. . . , "The judges having carefully considered the evidence tendered by the Judicial Committee of the Whangarei Racing Club and also to the Auckland District Committee, and having hoard and considered further evidence sub; mitted to them, find 'that in their opinion the Judicial Committee of the Whangarei Eaeing Club was perfectly justified in holding an inquiry into thu running of Princess Star, ridden by the apprentice Grice, in the Portland Hack Handicap, run on April 6, 1933, ; but whilo the judges are extremely anxious on all occasions to support the findings of judicial committees whenever possible, they consider, in view of the characteristic of the horse and the absence of fraudulent intent on the part of the owner and trainer, the judicial committee in this case was not justified in arriving at the decision to which it came. They think the apprentice Grice did not ride Princess Star to the best advantage, but beyond that there was no justification for the disqualification of the owner, trainer, and rider of Princess Star under rule 295 of the Bules of Racing. They therefore dismiss the appeal and order the deposit to be refunded.'"
