LOVING CUP CASE

AUCKLAND, 16th September

The case in which £700 is claimed as damages for the shooting of the racehorse Loving Cup, allegedly in mistake for Glen Maree, was continued in the Supreme Court to-day. The plaintiffs were Mervyn Wells and James Taylor, of Cambridge, and the defendant Norman Austin, of the Te Papa boiling-down works.

It was alleged that negligence on the part of the defendant, or his agent, was the cause of Loving Cup being shot. Several witnesses for the plaintiffs stated that Loving Cup was not suffering from an injury. Witnesses valued the horse at £750.

For the defendant witnesses said that the horse had an open wound and was walking as though sore.

The hearing was finished late to-night. Decision was reserved.
