RESTORING NAPIER

TOWN PLANNING REGULATIONS

A supplement to tho "New Zealand Gazette,' ' published last evening, contains Napier town-planning regulations under the powers conferred-by the Hawkes Bay Earthquake Act.

It is provided that for the purpose of .assessing the betterment increase, the value of land, exclusive of such increase, shall be the sum which the Court considers its worth to have been on 4th February last —the day after the earthquake.; Betterment increase means ascertained or estimated increase ,in the value of the land, and includes any increase in value fairly attributable to. the anticipation of any scheme. It does not include a proportionate increase in value of the whole of the land in a developmental area attributable to the existence of a •scheme having general and equal application throughout the area. The increase in value includes every increase estimated to accrue within a period of five years from the date of the scheme coming into force, or a period of one year from the completion of the work by reason of which betterment is /claimed M;o exist, whichever date is the later. The Borough Council is entitled to recover the full betterment increase, notwithstanding that land may not be rateable property -within the meaning of the. Rating Act. _ Provision is made that compensation may be paid to any person having any estate or interest in any land taken for any purpose comprised in a town-plan-ning scheme, or injuriously affected thereby. ___^____^__
