Subsequently Duiininghain appeared at the Magistrate's Court, before Mr. T. B. M'Noil, S.M., charged with aiding or abetting Ernest Cedrio Chappell and Doris JTordycc Chnppell on Oth April, 1929, to mako a declaration that would amount to perjury if made out on oath or affirmation. The declaration in question was one in support of an application. ,by Eraost and Doris Chappcll for a loan from the Superintendent of the State Advaces Department, Wellington. Sub-Inspector Ward asked for a remand to enable the accused to appear at Auckland on 4th December. "The charge is unfounded, and I have no doubt that when .I have an. opportunity of appearing it will be withdrawn,'' said the accused after the remund had been granted; Ho stated that previous to his arrest on board the steamer he had never had any indication from the police that there was any charge against ,him. The only word he had that -the polico were making any inquiries was by rumour. When applying to the Magistrate for the suppression of his name Dimningham said that the charge against him was a claim against hia professional standing. It was very awkward to bo arrested in a town where ho knew practically no one. The accused said that the tickets he had in his possession for the trip to America were, stamped for the return journey, so there was no question of his trying to escape from the country. The Magistrate said that he could not make an order for the suppression of the accused's name. Bail was fixed at £300, deposited by the accused, and one surety of £300.
