COMPLICATED CASE
Lithe Supreme Court to-day, the hearing of an action was commenced relating to the ownership and sale of .certain motor-cars. Traders' .Finance Corporation, Ltd., were plaintiffs, and General Motors Acceptance Corporation were defendants. His Honour Mr. Justice Ostler occupied the Bench. Mr. R.- M. Grant (Auckland) appeared for the plaintiffs, and Mr. H. F. O'Lcary and Mr. T. P. Cleary for tho defendants. The transactions in connection with the purchase and sale of the cars were very involved. In the statement of. claim, the plaintiffs alleged that the defendants had wrongly seized, cars which' had been sold by the Bishara Bros., of Taumarunui, to, various clients, and that two of theso were financed by the plaintiffs; that the defendants seized the ears — one ear because it was still subject to a wholesale storage agreement in favour at the defendants, and tho other because the defendants had financed the car for a retail buyer, which car the buyer had returned, and which was sold to a second buyer financed by the plaintiffs, and that "the first sale was not paid off out of the proceeds of the second sale. The sum. of £18& 15s 6d was still owing, on one car, and . £.83 11s on the other. The statement of defence contended that the defendants were the owners of the ears at the time tho sales were1 made; Also, that if it were proved that tho cars had been seized by tho defendants, then tho seizure was lawful. It was further asserted that the present proceedings were a breach of an agreement which had been entered into. The hearing of the ease is proceeding.
