An ex parto application was heard to-day in tho High Court of Western Samoa, on behalf of Olaf Frederick Nelson, formerly legislative Councillor of Samoa, for leave to serve a summons and statement of claim out of Samoa and in New Zealand upon General Richardson, the former Administrator. The cause of action alleges that the deportation was ultra vires and invalid. Judge M'Carthy refused the order on the ground of concurrent jurisdiction in New Zealand, and said that as both parties were th^ere the bringing of a case in Samoa would involve avoidable expense. ■ ■
