NEGLIGENT DRIVING
A CALLOUS MOTORIST

' At the Police Court to-day, the act* journed case of alleged dangerous dri^f ing against Duncan M'Phail was con, eluded before Mr. Bundle, S.M. The) ease arose out of a motor collision mi 30th April at Peebles. A car drivel by the defendant, and a motor-cyclisti William Gordon Smith, collided. Smith? suffered a broken leg. After hearing lengthy evidence, th*i Magistrate stated that there had beeuS:' a considerable amount of evidence bj* both sides as to. the defendant's sq4; briety. He -was not intoxicated, o£ noticeably under the influence o& liquor, but the Magistrate was of tK* opinion that the liquor consumed ha<y, affected him to some extent at t\k£ time of the accident. A motorist whc£ had taken a drink, but was yet quite?* sober, muet accept the consequences]? The defendant had not slowed downf when dimming', and was theieforor guilty of negligence. One would thintf^ that the occupants of the car woulds be chiefly concerned about the injure<£i man, but M'Phail had been utterly eal* lous. His subsequent actions showed that as he did not go and see Smith, oif: ascertain his injuries. The Magistrate found M'Phail guHiivt of negligent driving, and fined friin*j £5, with expenses £3 12s 6d, and e«6?&i £1 Bs.
