MONEY PUT INTO FARM,

An action concerning the position of a brother who put' money into a farm came before Mr. Justice Macgregor at the Supreme Court to-day. The parties were. William Adolph Hesebeck against the Advances Superintendent and Henry Ludwig Hesebeck. Mr. 0. Duff represented plaintiff, Mr. C. H. Taylor the superintendent, and Mr. A. W. Blair the defendant, Hesebeck. Before the case proceeded, his Honour suggested that the superintendent should pay the money in his hands into Court,. and that procedings against him should then be stayed.

The position was that in 1904 Henry Hesebeck took over a farm, and after working on. it until 1915, got it ready for stocking. _ The brother then put in £350, and a joint tenancy was arranged. The brother only worked for a short period,' and then left the farm. Some time later, defendant arranged a sale at £3750 for stock and farm, but plaintiff delayed forwarding his papers, and the sale fell through. The slump came, and the property was finally sold up for £2000. The State Advances Department took the money owing, and had in hand £1047 11s Id. In this plaintiff claimed a half share.

His Honour suggested that the matter was plainly one for arbitration. The Court adjourned to enable counsel and parties to discuss the matter.
