DAMAGES CLAIMED.

AUCKLAND, This Day. As the sequel to the death of Mrs. Evelyn G. Stevens, widow, at Ngartahia, an action, has been commenced in the Supreme Court, in which the execu-' tor and trustee in her estate sued David Douglas Wallace Martin, medical practioner, and James Thomas Douce, architect, claiming £1500 damages. Plaintiff alleged that on the night of 17th May Mi-s. Stevens was knocked down by Dr. Martin's car, receiving injuries to which she succumbed; that Dr. Martin was driving north, and Dpuce driving in the opposite direction, with headlights casting a brilliant glare along the road. There were three young children dependent on deceased.

Martin admitted that Douce's lights were dazzling, but denied he ran over or knocked down Mrs. Stevens. He claimed the fatality was caused by deceased's negligence, by tho combined negligence of Mrs. Stevens and Douce. Douce made similar denials.
