PUBLIC NOTICES. LOCAL BILL. WELLINGTON CITY CORPORATION. WELLINGTON CITY, MILK SUPPLY AMENDMENT. ■VTOTICE IS HEREBY GIVEN that it xl is the intention, of the Wellington City Council to introduce in'the forthcoming- Session of Parliament THE WELLINGTON- CITY MILK SUPPLY AMENDMENT BILL. The objects that the said Bill is intended to effect are: — 1. To establish a Board consisting of three persons, one appointed by the "Minister of Agriculture on the recommendation of the_ Wellington City' Council, one appointed by the Minister of Agriculture on the recommendation of the Wellington Dairy Farmers' Co-operative Association, Limited, and one person who shall be the Chairman appointed by the Minister on the joint recommendation of the above-mentioned appointees. Provided that if the appointees referred to fail to appoint the third member for seven days after their appointment, the Minister- of Agriculture shall appoint such person, who shall in such case be a Judge of the Supreme Court, a Judge of the Court of Arbitration, or a Stipendiary Magistrate.. 2. To provide that every appointment shall ba gazetted, that such gazetting shall ba conclusive evidence of appointment, and^that every, appointment shall, subject to- the provisions of the Act, remain in force for three years. /3. To provide for the removal of appointees, for disability, insolvency, neglect of duty, or misconduct, to provide for the filling of vacancies on the Board, and to provide that if the said Company ceases to exist the Minister shall make the appointment to be made by it. 4»To provide for Meetings of the Board, to fix a quorum thereof, to provide that the Clerk of the Magistrate's Court shall be Clerk of the Board, ! and that the Board shall have an official seal. 5^ To provide .that the functions of the Board shall be fo hold all such inquiries, to give 'all such decisions, awards, and determinations, and to do all such other acts and things as may be required by the Act or may be necessary to carry out the purposes of the Act. 6. To provide "that minutes, of the Meetings of the Board shall 'be kept by the Clerk. "\- \- ' ' ' ■ 7. To determine judicially x and award on any one or more of the following matters:— . . (1) The price that shall be paid for milk purchased by the Council for its milk supply during any.milk year being the period commencing' on the 16th day of August in one year and ending on the 15th day of August in the next. (2) Any matter relating to the conditions and supply of, milk; and in parr ticular, but without affecting the generality of tha.matter above-mentioned, .(3),Any matter which has heretofore been the subject of agreement between i the Council and any milk vendor, or any matter in the opinion of the Board is ancillary to or necessary for the completion of any award made by- the „ Board, it ;being clearly understood that no matter oh which an agreement has~ been arrived at between \the Corpora-' tion and any supplier shall be, subject to variation -by any act of the Board as between such supplier and the Corporation

To make the following provisions in. respect oi the'fixation of prices .for milk supplied to the Wellington City Council: — (1) In fixing the priees_for milk the Board may lix variations in prices according to the place at which delivery is made by the seller to the Corporation. (2) The Board may also fix the amount'which is to be allowed to, the Corporation for the conveyance/of milk for. any distance by motor or railway; and the' Corporation shall be entitled to deduct from the price fixed by the • Board any such allowance. (3) The conditions and prices fixed by the Board in respect of any application shall, so far as the same are applicable, govern and apply to all purchases made by the Corporation during the milk year to which such decision applies; and every supplier of milk during any such year "shall, subject to any agreement made between such supplier "and ■ the Corporation,. be bound by such conditions and prices as if they had formed part of a. contract made between such supplier and the Corporation for' the sale and purchase of his milk during such year. (4) The' Board, in fixing prices, shall' be guided by prices, of milk products obtaining in New Zealand or England, provided always that; in fixing increased price*! for any period between the 16th. day of April and the 15th day of August the Board may take into consideration the extra. labour and extra ■ cost ■ necessary for the production of milk during that period. 9. To provide that disputes and differences shall be referred to the Board, and to fix the fees payable to the members of the.Board. ~x ' •' ' 10. To provide that no person directly interested in the production or sale of milk in the "province of Wellington,' and no supplier or officer or member of the Council, shall be eligible to be appointed or to be or to remain a member of the Board. ( ' 11. To' provide, subject to' certain variations made by the Act, that all applications to the Board shall be deemed to be submissions under -"The Arbitration Act, 1908," ras-if thel Board .were three arbitrators appointed under that Act. '..". 12. To provide that, the Minister of Agriculture may by regulation :— (1) Prescribe such fees, as he thinks fit to be'paid by applicants in respect of hearing or in respect of the issuing of awards or copies thereof,- such fees to be paid into the public account. . (2) Prescribe such forma and pr,o----i cedure as ho thinks fit for the purpose of carrying the provisions of tnito Act „' into effect; ■'<■-.' '■ (3) Prescribe the remuneration to be paid to the Clerk and the fees (if any) to be paid to the person appointed as Chairman. , ' ' . 13. To provide that no decision of the Board shall be'quashed or set aside in any proceeding except on grounds of fraud affecting the making of the award ■ -.14. To' amend the Wellington City Milk Supply Act, 1919, by enacting -the following provisions:— ' ' • ' (1) Section 2 of the Wellington City ■ Milk Supply Act, 1919 (hereinafter termed the Principal Act"), .is hereby amended, by repealing immediately after the word "means" in lino seven --thereof the words "(a) a milk-house - milk-shop, dairy, factory, or any other place where milk is collected, deposited treated, separated, prepared, or manufactured,' or is sold, or offered or exposed for sale, and includes (b)."' ■'.. (2) Section 4 of the Principal" Act is hereby amended by repealing the words . "the last preceding section" in line one "thereof and by substituting therefor the words' "this Act.". . ' ■ . . (3J Section/12 of the Principal Act is' hereby amended as follows:— (a) By inserting immediately after the word "City" in the third line thereof the words "as it existed on the first ■ day of January, 1924." (b) By inserting after" the word "exact" in.' line six thereof the word "daily, and, by inserting immediately after the word "record" in the same line the words "in proper books of account." - (c) By repealing the word "obtained" m line seven thereof and by substituting the word "produced."
