CHARGE AGAINST LICENSEE DISMISSED
On a charge of exposing liquor for sale after hours, the licensee of the Post I Office Hotel, Alice Herdman, appeared before Mr. E. Page, S.M., at the Magistrate's Court to-day. In dismissing the information, the Magistrate remarked that the, prosecution relied upon the fact that on entering the bar of the hotel after hours, three people, Hilton, Mrs. Fawcett, and M'Naughton, who had since been con-, victed for being illegally on the premises, were found there. The last men-" tioned was the only one whose actions could be questioned, as the others were boarders at the hotel. As pointed out by counsel for the defendant, in the case of M'Naughton the onus was on him to show that he was on the premises for a lawful purpose, but in regard to the licensee, it rested with .the prosecution to prove the offence." Although, the facts were such as would arouse a great deal of suspicion, concluded the Bench, the evidence fell short of definite proof of the charge.
At the hearing the prosecution was conducted by Sub-Inspector Lander, and* Mr. H. F, O'Leary appeared for the defendant.
