WOMAN KNOCKED DOWN BY MOTOR.

A civil action was commenced in the Wellington Supreme Court this mornings before Mr. Justice Hosking and a jury of four, in which William Thomas Lapworth and his wife, Minnie Maud Lapworth, represented by Mr. R. Kennedy, ■proceeded against James Joseph Bourke, woolbroker, represented by Mr. E. P. Hay, claiming £48 17s 6d special and £250 general damages, as a result of injuries received when defendant's car struck the female plaintiff in Victoria street on 9th October, 1922. Plaintiffs alleged that defendant's car, carelessly and negligently managed, was driven without warning out of Willestou stueet at an excessive speed, and on the wrong side. Female plaintiff sustained two broken ribs and other severe injuries, and was incapacitated for a confciderable period. Ths defence consisted of a. denial of negligence or carelessness. Defendant stated in his defence that the car was driven on the proper side, at a slow pace. Female plaintiff stepped on to tliQ road, having a full view of the approaching car, and having ample time to cross the road. She hesitated in her course, turned, and ran backwards and forwards on the road, with the result that, in spits of all defendant could do, she was e;truck and knocked down.
