QUESTION OF CONTRACT.

Before his Honour Mr. Justice Hosking in the Supreme Court to-day, an appeal was heard against a' decision of Mr. Page, S.M., delivered in the Magistrate's Court. The parties were B. W. Cameron and Co., New York, merchants,1 with branches in the Dominion, (appellants), and A. Ade&j and Son, .soft goods merchants, of Dunedin. The plaintiffs in the lower' Court .sued the defendants, claiming £199 17s lOd, the difference between the price at which it quantity of blue denim was sold to defendants, and the price which tho goods realised upon sale.

The defendants contended that (1) there was no concluded contract; (2) that insurance effected did not comply with the contract; and (3) that defendants were within their legal rights in treating the contract ac at nut Mid m consequence of the action of plaintiffs in insisting on certain financial arrangements being made by defendants, and in plaintiffs stating that unless these arrangements were made the shipment of the goods would be suspended. In the lower Conrfc judgment was given for defendants.

At the hearing to-day, Mr. G. G. Watson appeared for appellants, and Mr. C. J. White for respondents.
