AGREEMENT STILL IN FORCE
There appears to be an impression in some quarters that, as the waterside Workers' agreement was made for the period 16th March to 31st' December, 1916, if, is not now in operation. A reporter made enquiries of-the Labour Department regarding this matter, and was referred to section 25, subsection 4, of the Industrial Conciliation and Arbitration Act, which is definite on this point. It states :— '" Notwithstanding the expiry of the term of the industrial agreement, it shall continue in force until superseded by another industrial agreement or by an award of the Court, except where, pursuant to the provisions of sections , 21 and 22 hereof, the registration of an industrial union of workers bound by such agreement has been cancelled." The sections provide that cancellation cannot be given effect to while Conciliation Council or Arbitration Court proceedings are in progress until the decision has been given, and that cancellation does not relieve the union or any member from, the . obligation of any industrial agreement or award or order of the Court.
