judgment v,-as given by his Honour Mr. Justice Chapman in, the (Supreme Court this morning in an originating Eummons issued by the trustees of the lato Thomas Cawthron, of Welson, io ascertain "whether they were bouad or authorised fco pay for the construction -of a bridge over the_ Maitai Biver and a road over Britannia Heights, to be known as the Queens-drive. The affidavit disclosed that the deceased had contemplated carrying ont these two ■works, but died before i;hey could be -carried out. His Honour determined that neither claim by the City Cotmciil against ihe trustees was enforceable. At the healing, Sir John Findlay, K.G., with him Mr. D. E.
