— «. DEFINITE LINE OF ACTION BY MAGISTRATES. (BY TELBCRAPH— PKKSS ASSOCIATION.) AUCKLAND. 27th May. « Of a large number of applications for orders under judgment summonses which came before Mr. Kettle, S.M., to-day, only three or four were successful. In one of these caws the debtor acknowledged that he drank, and in others the debtors did not appear. His Worship stated that all tho Magistrates had considered the matter, a-nd had decided that the judgment summons system was being abused. Where debtors could show that they did not have tho means, or were honestly trying to pay, no order would be made ; neither would adjournments be granted and the fear of imprisonment kept hanging over tho heads of debtors. Solicitors should exhaust all methods open to them under ordinary judgment before seeking an order. One solicitor protected that this system would result in the starving of many people, owing to the stoppage of oredit. but the Magistrate indicated that he did not fear this result.
