APPEAL AGAINST AN INJUNCTION
On 26th June at the Supreme Court his Honour the Chief Jiistice (Sir Robert Stout) gave judgment on the application of the Spring - Creek River Board to enforce an injunction 1 against the Lower Wakau River Board against the continuance of a groyne in the bed of the Wairau River. His Honour eaid that from an inspection and the evidence given before the Court he was iorced to the conclusion that in ordinary flood the groyne would prevent the flow of the water in its customary channel and that it might cause the water (and in time, perhaps all the water) to flow down the Wairau channel. He made an order that the groyne, up to a certain point, be removed, and that if the order was not carried out the Court would proceed further. Costs (50 guineas) were grafted, and witnesses' expenses and disbursements. The order was suspended for a fortnight in order that Mr. M. Myere (for the Wairau River Board) might carry the case to the Court of Appeal. This morning, when the proceedings of the Court opened, Mr. Myers applied for a date to be fixed for the hearing of the appeal during the present sittings -. of the Court. His Honour the Chief Justice (Sir Robert Stout) suggested that, as Tuesday week was clear, that day should be decided upon. Mr. Myers replied that a great deal of printing was necessary, and expressed doubt ac to whether it would be ready in time. The Chief Justice remarkedN-that there should be no trouble in this direction. "Look at the size of the newspaper brought out every morning in a few hoUre," he remarked. Mi. Myers re- 1 plied that he would do his best to be ready, and Tuesday, 21st July, was consequently fixed as the date for hearing the appeal.
