Performers engaged for dances shall be paid 12s 6d from 8 p.m. to 11 p.m. ; 15s lrom 8 p.m. to midnight; and 5s for each hour in addition. Performers at refreshment rooms shall rocoive 2s 5d per hour. Employers aro at liberty to ongage any person, whether a member of the union or not, but if such person shall fail to join the union within .seven days after being requested, he shall be liable as for v breach of the award. The award operates from Ist July, 1912, until l&t July, 1915. In a memorandum. Judge Sim says. — The provisions contained in the award, except thoso relating to dances, balls, refreshment rooms, and preference, were agreed on by» the parties when the matter wa& before the Court of Conciliation. Wheu th© matter came before the court, the union' did not object to these provisions, but it asked the court to alter the proTigions of clause 6, and to Ex at a higher rate the wages for continuous picture entertainments. In other words, the union attempted to repudiate the agreement made by its duly appointed representatives with th* other parties to the dispute) and, wbilo keeping whatever the employer* had _ agreed to concede, sought to obtain (something more. That clearly it cannot be allowed to do, and the award hab been made in term 1 - of tho recovnmoudation. It may be that tho performers at continuous picturo nntertaimuents arc entitled to some\fcoiisidoration by reason of tho fact that they work longer hour? than performers nt ordinary picturo bhowtj, but, in view of tho agreemont tnado by tho union, tho matter is not really open for consideration no tt.
