TITLES OF MINERAL LEASES.

Radiant mineral case in which I<-. Johnton sought to recover from Ferguson and Gascoync, of Napier, possession of titles to certain mineraJ leaete at Mount Radiant, and also £2500 damages for alleged illegal retention of ?*me. the warden (1) refused the prayer of plaintiff in regard to assignment and damages. (2) He decreed that the defendant should hold the leases on trust for pensons advancing money to pay creditors, all purchasers of shares, prior to 11th October, and for Johnson a-nd Purdy. (o) That the agreement of 13th May, referring to the sale of one thousand shares to Ferguson, should he cancelled, and that defendant should deliver over the six agreement forms referred to in the judgment or, in the alternative, execute an indemnity to plaintiff against any claim that may ariee in respect of any dealings with them on the part of defendant*, and account for the proceeds of sale of any of them (if any) cold. It was understood that, if an appeal were not prosecuted, further terms and the Sitestion of costs would be settled after le hearing of the parties by the warden.
