CHARGES OF THEFT. ACCUSED FINED £5.
In the Magistrate's Court to-day, before Mr. W. G. Riddell, S.M., Arthur Tobin appeared to answer five separate informations charging him with theft of sums of money aggregating £1 19s sd, which he is alleged to have received in February^ last, on terms requiring him to account for the same to Francis Edward Green. Accused, a young man, pleaded guilty to all charges, and. was defended by Mr. P. J. O'Regan. Sub-Inspector Norwood stated that fTobin was employed as a deliverer of milk for Mr. Green. He received the accounts when made out, and was to collect the sums from the customers. During February he received forty-three accounts, and he had failed to account for tihe items specified in the charges. Accused left Wellington instead, and was arrested on his return. Tobin had not been before the court on any previous occasion. Mr. O'Regan asked that accused be leniently dealt with. Tobin was the sole support of his parents, who were old ana helpless. His mother was a cripple. Hitherto accused had enjoyed the full confidence of his employer, and his temptation was strong. The amounts involved were small. His Worship said that it was impossible for him to accede to counsel's suggestion that accused -be convicted and ordered to come up for sentence when called upon. Tho thefts, though of small amounts, extended- over a period, and the rule of the Supreme Court Would not permit of the course suggested. The fact that he was the sole support of his parents should be taken into consideration. His Worship convicted Tobin, im- j posed a fine of £5, and ordered him to j repay the amounts. Default was fixed at 21 days' imprisonment, and 48 hours was allowed in which to pay the fine.
