INTERESTING CIVIL ACTION.

TREATMENT OF THE EYE. Treatment of the eye and the fees char- ed for the same was tho subject of ft civil action commenced in the Magistrate's Court soe days ago, before ' Dr. A. M'Arthur, S.M., and resumed to-day. Tho plaintiff was Dr. Emilio BorghetU, eye specialist, of Wellington, and the defendant James Reid, Cartertou, farmer, the claim being £88 4s for operations, attendances, etc., on the defendant's son Randall Reid Evidence given by plaintiff showed that the patient, a boy, was under his core for about three months, and that eventu ally he was taken away from plaintiff, and placed under the treatment of D<* Wcbeter at a- time when the eye was progressing in a way with which plaintiff was entirely satisfied. Had plaintiff's treatment been continued witness was satisfied that the results would have been beneficial. Defendant paid into Court £50 of the amount claimed, but under the circumstances plaintiff declined to accept it. Mr. Grej appeared for plaintiff and Mr. Findlay fur the defendant Thos Jas. Reid, son of the defendant, and~brother of the patient, also gave evidence. For the defence it was alleged by Mr. Findlay that plaintiff agreed to accept £50 for all of the work and to finish the case for that sum, but that after the second operation he repudiated that bargain,- and the Jioy was therefore taken away. There was, counsel said, nothing due to plaintiff, because he had broken his contract. If, however, there was anything due it could not be more than £50, and even on the ground of allowing a reasonable remuneration, £50 was ample in any case. 'As far as the question of treatment was concerned, all the defendant knew was that the boy was no better by reason of the treatment he received 'from plaintiff. The doctor himself had raised the question of treatment by endeavouring to justify his own treatment and throw blame on other medical men ; hence counsel had to go into that question in order to protect them.
