Macartny, be granted on the following conditions : That the way be constructed'to a width of 20ft throughout, with a footpath 3ft wide on "one side; that the angle at .the change of direction be splayed for a length of sft ; that concrete kerbing be substituted for totara along the footways ; that a crossing of woodblocks and metal cover be placed at the entrance to way io the satisfaction of the City Enginesr; that a light bs provided. and maintained for all time ; that no further subdivision bo made, and .the .lumber of houses shown on drawing not exceeded ; that ths right-of-way and etormwaie-r drain .be maintained in good order for all time by ths owners, to the satisfaction of the City Engineer; that the above conditions bo registered against tho title; that the work above suggested be carried out within i'hreo months from date of approval by C-ounri!.

Councillor Frcet, in moving that the clause be referred back to ■the committee, protested against the making of more rights-of-way, which tended to t'hs making of slums. The motion was seconded by Councillor M'Laren, who followed .tho same lino of argument -an the previous speaker. The proposed action w;:f> reprehensible, and already tli3 city had been hauled over tho (oak by cri'ti:3, from ths Chief Justice downward^, for naving created slums by means of rights-of-way. The city was riddled with Ihom, and th-sy should be got rid of, instead of the number being increased. A.6 <<> tha application .iow before tho Council, lie understood there \va3 plenty of larit! available, and an effort should ba made to get a Toad provided instead of a right-of-way. Councillor Trevor eluded Councillor Frost for having -failed to attend a meeting at whicli Ova application wat previously- considered. Thy Council had given full consideration to this particular application. Permits had been ghc-n to build three housee, which had half-an-acro between them, and the Council should not now stick up the application for tha right-of-way; He had no doubt it would be all right. Councillor Winder: Th« committee io only recommending action that the Council itself proposed with regard to ono of its own pieces of land. Councillor Ballin(*er : Th» City Solicitor reported that it wa'i k-gitl to have such a right-of-way. Councillor Gibb3*: We know it's legal, but is it right?
