DECISION OP THE COURT OF APPEAL. CONVICTION OF THE KENNIFS UPHELD. • [press association.l BRISBANE, 10th December. The Full Court, consisting of the Chief Justice and three other Judges, have heai'd the appeal against the conviction of the brothers Kennif, who "were sentenced to death for the murder of Constable Doyle at Camarvan. The grounds of the appeal were that there was not evidence of Doyle's death, and no evidence that Patrick and James Kenniff had acted in concert. v The Court upheld the conviction. "Mr. Justice Real' dissented. He eaid there was sufficient evidence that Doyle was dead, but there was no evidence to ■support the theory that James Kenniff took part in ' the murder, unless the Court accepted a conjecture that James would naturally help his brother. His presence at the scene was involuntary, he being at the time a prisoner in Constable Doyle's custody.
