A POLICEMAN CHARGED

« This afternoon, before Mr. Martin, S M. ' Thomas Nestor, of Eketahuna, bailiff- and police constable, was charged with having committed perjury by making a false statement on oath to the effeot that be served one W. W. Bodmin with a summons personally at Tntaekara. Mr. H. D. Bell appeared for the prosecution, asd Mr. Skerrett appeared for Nestor. The information was laid under seotions 113 and 115 of the Criminal Code Aot. There are other charges of perjury in connection with the same matter. W. P. James, Clerk of the Wellington Magistrate's Court; gave evidence as to the out against Bodnun going by default* and H. Aulin, J.P., stated that an affidavit of service bad been sworn against him by the aooused. A report of the constable relative to the servioe of the snmmons was pnt in by Mr. Skerrett, in which the accused stated that ho went to Tutaekar* on three occasions to effeot service of tbe summons in question, and was unable to find Bodmin, and on the last occasion he told Mr. Clark, Mr. Bodmin's manager, that he had a summons (to Iserve upon Bodmin. Mr. Clark said Bodmin was at tbe other aide, but he would accept service as his agent. Nestor thereupon served the snmmons on Mr. Clark, and made the affidavit as to personal service.
