DISTRICT COURT.
? THIS DAY. (Before Judge Mansford.) BLACK V. i. C. BICHTER. In this case plaintiff, a coachbuilder in WelUngtoD, sued defendant, a settler at Palmers ton North, for £99 17s, for a buggy and harness supplied. Mr. Forwood appeared for the plaintiff, and Mr. Stafford for the defence. The case for the plaintiff was, that the defendant ordered the buggy and harness, and they were sent to him at Palmerston North, but he then refused to take delivery. The defence was, that the articles were never ordered, and tbat even if so, the contract was void as it was not in writing. Defendant admitted that be ordered a buggy, but said that it was of a totally different description. The one gent was useless to him.
On the other hand the plaintiff and his foreman . produced books showing the entries mad c when the order was given, in which the buggy was descnoed like the one sent. Mr. Mansford gave judgment for the amount . claimed, with costs.— -Mr. Stafford gave notice of appeal. 1 - 7- 3~.-.»~, CASBS ADJOURNED. The cases of Macdonald v. Beere and Davics v. City Tramways Company were adjourned for a iortnight, on the application of the defendants in each oas«. The case of Johnston and wwtiwc^vtJPollock and another was struck out iv consequence of the non-appearance of the parties.
