James Holt: Appeal againsttho Municipal assessment,, sections's2 and 53, block XXIII, assessed at L3o,' reduced to L2G ; sections 17 and 18, block XXIII, assessed at LOS, reduced to' LS2. An apjwal was lodged against the assessment on the coal pit, on the grimed that it being situate on a coal reserve it was without the boundary of the Municipality, and accordingly not rateable. Mr Wilson, who conducted the case for the Corporation, said the boundary of the town, according to the proclamation, Was the river edge, the raining reserve was therefore within the boundary of the town. His Honor said he must affirm the assessment. His Honor also said it was generally thought that “lues, were exempt from all rates, that was the case, excepting with coal, which, by an act passed in the reign of Elizabeth, wore made rateable.
