Since tho Dunedin totalisator case W. Stuart, -who obtained a judgment against the owners of the "instrument for money invested by him on a horse which did not win, has been in the Resident Magistrate's Court on a judgment summons at the suit of Kirkpatric'k, Glendinning and Co. Stuart then swore that the money invested belonged to Mr Charles Burt, now in England, who left it to be put into the totalisator, and the winnings given to charitable institutions. Stuart swore that ho handed tho money over toD. M. Stuart, his brother, Mr Charles. Burt's representative. , The case was postponed for a short time for the production of Mr D. M. Stuart, and he was present when the.Court again sat, but the defendant was absent. On Friday last the defendant was ordered to pay the amount of the claim by monthly.instalments of £2 35,6 d eaoh, or in default-1,4 days' imprison* ment. . ~. ~'.' ■ .'., . ~:. ■■.■'.;■.. ■ ■ ••.
