POLICE COURT.— SHORTLAND. Monday, February 7.

(Before G.B. Davy, Esq., R.M., and John Styak, Esq.. JP) Shooting Case at Ohinemubi. — Mr. Dodd appeared for defence. — Sergeant Lloyd deposed : I first saw the accused in the policeoffice on the 2nd of February. The warrant was read to him. He said : "I admit shooting at John Kinnan, but I did not intend to shoot i him. I could have killed him if I wished to do so. I only discharged one barrel of the revolver." ' I then showed him the revolver, and he said, "That is the instrument with which I fired. Three of the chambers are still loaded, one is discharged, and the other contains powder without a shot. — Dixon deposed that Sheridan came to him and asked him for the loau of a revolver to shoot a dog that bad been stealing his food out of his tent. He lent him the revolver. — John Kinnan deposed : Myself, the prisoner, and some others were playing cards in Sheridan's tent. We kept up the play all night till five o'clock in the morning. Just previous to the game being broken up some excitement took place, because there had been some extra money staked. The accused and a man named Reynolds were playing last. They were playing for £5 a-side, and Reynolds won it ; and then the game broke up. About two or three minutes afteri wards he asked Reynolds to give him the money back, as it was not right. Reyno ds replied that he would not. Sheridan, after that, called Eeynolds outside, and they both went out. Sheridan asked Reynolds to give him the £5. Reynolds said — no ; he would not give it back. I then told Sheridan he was very foolish to bet his money in that manner, and lie said, ' ' How could I help it?" He then pulled out a revolver from his breast. Sheridan then said to Reynolds, "If you don't give me the £5 I'll shoot you." He was holding the revolver in his hand, cocked and pointed in the prosecutor'? face After that tney both went down to Sheridan's tent. When they got down to the tent Sheridan again pointed, the revolver at the prosecutor, and demanded the £5 ; at the same time I shouted out, " If you go flying about with that revolver every day, and if you use it, your life won't be safe in these quarters long." He then turned round and said, "I'll shoot you too," and started up to me with the revolver in his hand. I felt afraid that he would shoot me, and I stepped alongside the other man. Sheridan was then a little excited, and called out to me, "Oh, you covvard." I told him he was a d liar for calling me a coward, and asked hini why he was going to shooc me. 1 told him to go back to the man who had his money, and also told him to shoot me if he thought I deserved it. He then fired at me. I wheeled round, and the shot caught me in the lower ribs. I felt that I was wounded, and I walked away, and cried out "Oh." I then took off my coat and waistcoat and lay down Some men then came and carried me down to the landing-place, put me on board a boat, and brought me down to fahortland, where I got my wound dressed. — Dr. Lethbndge deposed that he examined the prosecutor, »nd found on him a gun-shot wound on his lower rib. He could find no traces of the bullet in the neighbourhood. There was considerable tenderness in the muscles m the back of the right side of the spine, and witness believed the bullet to be there. — Prisoner was committed to take his trial at the next session of the Supremo Court.
