STEADMAN T. P. WYNN. Claim 7s 6d for excessive toll. Mr. MacOormick for the plaintiff; Mr. Joy, LL.B., for the defendant. This was an action arising out of alleged excessive charges made by the defendant, who is a toll collector on the Otahuhu Road, upon the plaintiff, who is the proprietor of a four wheeled vehicle. The plaintiff alleged that he had been charged^ 2s on every occasion, which he paid under protest. The defence was that the plaintiff had been carrying passengers for hire, and several witnesses were called, who deposed that they had several times travelled in the waggon as passengers.
