PROVISION FROM FATHER’S ESTATE
Woman’s Share Increased From £5O To £2OO Dominion Special Service. PALMERSTON N., November 8. Brought under the Family Protection Act, an application was beard before Mr. Justice Reed in the Supreme Court in Palmerston North to-day ou behalf of Mrs. Gwendoline Edith Ebbett, Christchurch (Mr. J. A. Grant), for further provision out of the estate of her father, who had bequeathed her £5O and left the residue of his estate, of a net value of £2633, for equal division among his seven other children or their children. Defendants were George William Chatwin, executor of the will, for whom Mr. G. S. Tinney (Pahiatua) appeared ; Charles Edward Barrell, representing the adult beneficiaries, for whom Mr. P. 11. Watts (Hamilton) appeared ; and the Public Trustee, on behalf of the minor children, for whom Mr. J. P. lunes appeared. His Honour held that testator was entitled to discriminate among bis children ; that was a right which should not be removed. But other injustices were done iu such cases, said his Honour. It was suggested that plaintiff had contracted to look after her aged father until his death and had broken that arrangement, but that he had suffered no loss through it. His Honour increased plaintiff’s provision from £5O to £2OO. with costs, to be taxed out of the estate.
