RESPONSIBILITY FOR SON’S DOG
Damages Awarded To Cyclist Dominion Special Service. Napier, March 22. Responsibility for the action of his son’s dog when it caused an injury to a cyclist by knocking him oyer was placed .on the owner by Mr. J. Miller, S.M., in a reserved judgment issued at Hastings today. The case was one in which Thomas Andrew Atkinson alleged that the dog owned by the son of John Denis Heenan rushed at him and kuocked him aver while he was riding his cycle on a main highway. The court awarded him £65/9/9 damages and £B/11/- costs as a result of injuries received. Mr. W. S. Averill, who appeared for Heenan, submitted that there was no negligence in the care of the dog, and the plaintiff was guilty of contributory negligence by swerving. The magistrate stated that the cause of plaintiff’s injuries was the dog rushing out, and in his opinion defendant was responsible for the action of the dog.
