The chairman. Mr. C. G. C. Denner, said the board would soon have to review its tariff, but it would be useless doing anything in the meantime. Mr! J. RUNAWAY TRAILER

Claim by Owner of Damaged Car Palmerston North. September 15. A crash between a runaway trailer and a motor-tar had its sequel in the Palmerston North Magistrate's Court to-day, when G. C. Firth claimed f.33/2/- from W. Dustin as the cost of repairing damage done to hig car when a trailer attached to a car driven by defendant broke away and crashed into plaintiff’s car. The accident occurred on the Rangitikei Line, about a mile from Palmerston North, on March 26. - Mr. J. L. Stout, S.M., was on the bench. Mr. T. Rowe appeared for plaintiff and Mr. J. Grant for defendant. Plaintiff, who is a farmer, of Feilding, said his was driving into Palmerston North and he was not present. Neither he nor his wife had been in an accident before. Mrs. Firth said she was coming to Palmerston North from Feilding and saw tile ear coming toward her with the trailer attached. When nearly opposite her the trailer broke loose, striking the car she was driving. Her speed was hbout 25 miles an hour. Witness said defendant remarked after the accident that one of the trailer's wheels had. been the cause of the trouble. Tlie Magistrate remarked that he always kept clear of cars with trailers. The Rev. H. W. Page, who was a passenger in plaintiff's car, corroborated Mrs. Firth’s evidence. F. W. Senter, a mechanic, said the trailer was fixed to defendant's car by a half-inch bolt. His firm used heavier bolts for that class of work. Mr. Grant submitted that the accident was not due to the negligence of defendant, whom he thought was entitled to a nonsuit. “There is a suggestion that the trailer was not coupled properly,” observed the magistrate. “One witness said it was coupled with a bolt he would not use, but he did not condemn it.” Mr. Rowe quoted authorities to support the contention that the accident did arise from negligence. Observing that he had yet to hear of a case where recovery could be made where negligence had not been . proved, the magistrate reserved his decision.
