NEGLIGENT DRIVING CHARGE
Fatal Accident Near Napier EXPERTS GIVE EVIDENCE OF SPEEDS By Telegraph.—Press Association. Napier, May IS. Charged witli negligently driving a motor-car so as to cause death, Moss Wylie appeared in tlie Supreme Court to-day. Mr. Justice Reed presided. It was alleged that Wylie’s car met and struck a lighter car ami pushed it back sixty feet through a fence, killing Arthur Gordon Perry, of Wellington, and injuring three other occupants. The accident took place near Napier on April 11 last. Expert evidence was given of a test carried out in tlie locality of the accident. This showed that it was possible to take that particular bend on the correct side at 50 miles an hour. Experts considered that under the circumstances the car driven by accused would have been travelling at GO miles an hour and the smaller ear in which deceased was travelling at 20 to 25 miles an hour. A police witness produced a statement by accused after the accident, in which lie said he had two three drinks on tlie day of the accident. His speed at the time of the smash was not more than 20 miles an hour. For tlie defence, a car salesman, Thomas Michael Brennan, said accused's car, which he had driven, was very sluggish. Its maximum speed would be slightly over 50 miles an hour. The hearing was adjourned until tomorrow.
