CASE DISMISSED
Action Against Newspaper (Received February 6, 10.30 p.iu.)| Sydney, February 6. In the High Court to-day Mr. Justice Evatt dismissed without costs Egon Kisch’s action, for contempt of court against the “Sydney Morning Herald,” arising out of the publication of articles and letters between December 21 and Januaf'y 8 on the subject of whether the Scottish Gaelic could be regarded as a European language. - Mr. Justice Evatt said that the dismissal was without prejudice to any proceedings that might be brought in the New South Wales Supreme Court in relation to the publication of further letters on January 7 and 8, Before Mr. Justice Evatt gave judg ment the “Herald’s” leading counsel. Mr. Curtis, K.C., Intimated that his clients had instructed him unreservedly to express deep regret for some statements published “which upon examination, were found to be inaccurate, intemperate, and unfortunately offensive.” He also wished to assure the High Court that, there had been no intention of reflecting on the prestige or integrity of the court, which had his clients’ highest respect.
