Injured Waterside Worker

Judgment was delivered in the Arbitration Court yesterday in the case in which Oskar Joackim Mansner, waterside worker, Napier, claimed compensation from the Union Steam Ship Company for an accident which happened while he was assisting to load wool in the Kaliika on December 8, 1930.

Plaintiff’s statement of claim said that he was employed by defendant company when the accident occurred, and his right should injured so that he had since been totally disabled from working. He had been paid compensation at the rate of £3/13/4 a week until September 24 last, but he had been unable to settle his claim for further compensation by agreement with the company. Plaintiff therefore claimed a weekly payment of £3/13/4 from the date of the last payment to the trial, such further compensation as might be reasonable, medical expenses and costs. The statement of defence admitted the accident and the majority of the clauses of the statement of claim, but denied that plaintiff was totally disabled from working. It said that plaintiff had fully recovered from the effects of the accident about the time when the compensation payments ceased, and if plaintiff was at present totally disabled from working, the incapacity resulted from a disease, myocardial degeneration, and was not the result of the injury suffered in December, 1930. Both sides called medical testimony in support of their cases, and after retirement the court awarded plaintiff full compensation from the date of the last payment to January 31 and ten per cent, of full compensation for 13 weeks from that date, the total amount being £69/8/9, medical expenses and costs.
