Arbitration Dispute Is a mate a seaman? That question was raised in the Arbitration Court yesterday, when applications for. interpretations under the N.Z. Waterside Workers’ award engaged the Court. Mr. W. 11. G. Bennett appeared for the Waterside Employers’ Association and Mr. J. Roberts for' the Waterside Workers’ Union. The question raised was whether the mute of tbo motor-vessel Awahou committed a breach of the preference Clause by working with the crew, in the landing of cargo at Tokomaru Bay. The employers said that it bad been the custom for at least 30 years for the mates of small vessels working similar ports to Tokomaru Bay to act as hatcUmeu. For tlie workers it was contended that the mate was not a seaman in the industrial sense, the existence of the custom cited by the cm ployers was denied. His Honour Mr. Justice Frazer sai<l that if it were found necessary to have evidence of custom in small ports, a hearing would be arranged ut Napier or Gisborne.
