Palmerston North, May 6. General . damages of £4OOO and £629 special damages were claimed by Phillip Llewellyn Smith, a roadman, of Bunnythorpe, from Jonathan Symonds and Alice May Symonds, of Feilding, in the Supreme Court this morning before Mr. Justice MacGregor. The action was the sequel to a collision between a motorcycle ridden by the plaintiff and a motorcar driven by one of the defendants at Bunnythorpe on August 16, 1930. The statement of claim contended that the car was carelessly, negligently, and recklessly driven by Alice May Symonds; that Mrs. Symonds drove on the wrong side of the road at night, and failed to keep a proper look-out. As the result of the injuries received the plaintiff had been admitted to the Palmerston North Hospital, and after several operations had had his leg amputated above the Mr. Ongley, who appeared for plaintiff, said that Smith had had a number of operations, and as a result of gangrene setting in, had had his leg amputated below the knee. The infection had spread, and it was necessary to amputate the limb above the knee. Plaintiff, who was only 21 years, had been cut off from all the pleasures of life, while he had been debarred from following his occupation. , . x , ~ Judgment was entered against both defendants for £2404 (£lBOO general and £604 special damages).
