CLAIM FOR RATES

A dispute between the Eastbourne Borough Council and the Wellington City Council engaged the attention of Mr. Justice Herdman In the Supreme Court yesterday. The question at issue was whether the City Council should pay rates (amounting to £5B) on two lots of land within the Eastbourne Borough. Plaintiffs contended that the land was rateable and that the City Council had paid rates on it previously.

The defence was that the land was reserved for plantation purposes, and was, in consequence, exempted from rates. It was also claimed that trees had actually been planted on part of the land.

His Honour said that he would give a written decision.

Mr. E. Parry appeared for plaintiffs and Mr. J. O’Shea (City Solicitor) for defendants.
