WRIT OF HABEAS CORPUS (By Telegraph.—Press Association.) Auckland, December IS. Mr. Justice Blair has granted a writ of habeas corpus to release from prison Francis Cairns, of Aria, a farmer. Cairns had been committed to six weeks' imprisonment by a Magistrate for uon-pay-mne of the costs of an appeal heard in the Supreme Court, which arose out of an action by Cairns against a neighbour, whom he charged with being the father of his daughter’s child. That application was dismissed, also Cairns's appeal. The neighbour then sued Cairns for costs, and had him committed to gaol. His Honour, in granting a writ for habeas corpus, said it was a matter for substantial costs. He fixed costs at £l5 155., against the neighbour.

The contention of Cairns's counsel was that the Magistrate had no jurisdiction in order his-committal for non-payment of costs in the original proceedings. __
