INTOXICATED MOTORIST ♦ “TRANSGRESSED UNWRITTEN LAW.” Realising, according to his counsel, “that he had transgressed the unwritten law that a motorist should not take any liquor at all, Charles Walden, a ship’s cook, pleaded guilty in the Magistrate’s Court, on Saturday, to being intoxicated while in charge of a motor-car.
Sub-Inspector Lander stated that shortly after 5 p.m. on April 9, Mr. K. Douglas was driving his car towards the city, on the narrow road near the Kelburn Viaduct, when he saw accused’s car coming towards him in an erratic manner. Accused’s car struck him broadside on. Douglas and his passenger spoke to accused, and found him to be under the influence of liquor. Accused had a passenger in the car, this man also being intoxicated, and some bottles of beer were found at the back of the car. Accused disappeared from the scene of the accident, and was not located until the following day. Mr. L. J. Maule, counsel for accused, stated that his client admitted having Lad a few drinks before the collision took place, but claimed that he was by no means as intoxicated as had been alleged. Had he been so, he could not possibly have driven the car safely around all the awkward bends on the road from the city to the Viaduct. Walden, added Mr. Maule, would have defended the action had he not realised that a motorist should not take liquor. Accused had made compensation to Douglas by giving him his interest in his (accused’s) car. . The Magistrate (Mr. E. Page, S.M.) decided to fine Walden £lO, and ordered him to be disqualified from driving a car fcr twelve months.
