Since the enforcement of the city bylaw prohibiting any person from loitering on busy footpaths, a certain amount of public feeline has been roused because of the action of the police iu compelling bystanders to step on to the roadway (states the “Otago Daily Times”). Recentlv a reporter approached the town clerk, Mr. G. A. Lewin, with the object of ascertaining the City Council’s attitude on the matter. “The by-law is to be enforced with all reasonable thoroughness,’’ said Mr. Lewin,' “but ordinary commonsense must be used and it is the object of the council to prevent onlv loiterinq. A hard and fast rule cannot be laid down and each case will bejudeed on its merits but I do not imagine, for instance, that a person would be committing a breach in stopping to look at a shoo window. The police are simplv enforcing a city by-law that has been passed bv the council, and this policy will.be continued unless the courts rule that such action cannot be taken.”
