(BY Telegraph—Special correspondent.) Nelson, May 7. At the last sitting of the Supreme Court a civil action was heard in which Dr. Barr and others sought an injunction to restrain John Webley and Sons, carpenters and builders, from working sawing planing or other machines recently erected in tho localityof plaintiffs’ premises. Tho reserved decision of Mr. Justice Adams was given to-day, in tho course of which it was stated that the evidence as to the nuisance tlleged.was conflicting. If the evidence of pla'intiffs and their witnesses was accepted, making a failallowance for possible exaggeration, it was sufficient to establish their right to the injunction asked. The evidence for the defence was not, in the judge’s opinion, sufficient to displace the case made out by the positive evidence of plaintiffs. Defendants’ premises are tho only industrial plant in Collingwood Street, and there are twentytwo houses on three sides of the premises. Before the advent of defendants’ machinery tho neighbourhood was quiet. “I am satisfied,” went on His Honour, “that the noise complained of does in fact seriously interfere with the comfort physically of tho plaintiffs in the occupation of their houses, according to the ordinary notion prevalent among reasonable men and women.” The injunction was accordingly made, ami costs were allowed. At a meeting of the Hospital Board to-dav an application was by tho Golden Bay Coalfields Prospecting Co. (Wellington) for an option over tho board’s reserves in the Takaka district. It was resolved to offer no objection provided that Hie present lessee agrees.
