Toksday, Mat 15, 1877. (Before His Honor Judge Ward.) George Capstick v. W. J. Dyer.— This was an adjourned case brought by George Capstick, calling on defendant to show cause why his appointment as trustee iv the estate of E. N. Legge should not be cancelled, as plaintiff had lost the election of trustee by one vote, Mr Dyer having erased his name by proxy, aud substituted his own. Mr Dyer, by affidavit, showed his authority to do so.- -The case was dismissed.
