Public Notices MINISTRY FOR THE ENVIRONMENT PURSUANT to Section 20 B (7) of the Water and Soil Conservation Act 1967, the Minister for the Environment notifies the following draft water conservation order for the Buller River. THE DRAFT NATIONAL WATER CONSERVATION (BULLER RIVER) ORDER 1989 1. Title and commencement (1) This order may be cited at the Draft National Water Conservation (Buller River) Order 1989. (2) This order will come Into force on the 28th day after its notification in the Gazette. 2. Interpretation - In this order “Act” means the Water and Soil Conservation Act 1967. 3. Outstanding characteristics and features — It Is hereby declared that the Buller River and all Its contributing waters contains and provides the following characteristics and features: (a) Outstanding wild and scenic characteristics. (b) Outstanding landform values. (c) Outstanding trout and whitebait fisheries. (d) An outstanding amenity for water based recreation. (3) An outstanding feature as the largest river system within New Zealand remaining in a relatively unmodified state. 4. Waters to be preserved in their natural state — (1) Because of the outstanding features and characteristics specified in Clause 3 of this order, the level of Lakes Rotolti and Rotoroa and the quantity, and rate of flow of all their contributing waters except for Black Valley Stream, shall be preserved as far as possible in their natural state. (2) Nothing In this clause shall constrain the Issuing of water rights to the Department of Conservation for minor rlvver uses considered necessary for the management of the Nelson Lakes National Park. 5. Waters to be protected — Because of the outstanding characteristics and features specified in Clause 3 of this order all waters of the Buller River system, other than those preserved In their natural state as specified in Clause 4, are to be protected as follows: (a) No water rights shall be granted under Section 21 of the Act to dam the Buller River at any point from Its source at the outlet of Lake Rotolti to the sea. (b) No water rights shall be granted under Section 21 of the Act to dam the Gowan River. (c) Water rights may be granted to dam tributaries of the Buller River, other than the Gowan River provided that singly or cumulatively such dams will not detract from the outstanding characteristics and features specified In Clause 3 of this order. (d) Water rights may be granted and general authorisations made for other water uses, provided that the granting of such rights will not detract from the outstanding features and characteristics specified In Clause 3 of this Order. (e) Water rights may be granted and general authorisations made for the purposes of the construction, maintenance or protection of roads, bridges, pylons and other necessary public utilities, or for soil conservation, river protection or other activities undertaken pursuant to the soil Conservation and Rivers Control Act 1941. 6. Scope — Nothing In this order shall be construed as limiting the effect of the second provision to Section 21 (1) of the Act relating to the use of water for domestic needs, for the needs of animals, and for or In connection with flre-flghting purposes. The following bodies and persons have the right to make submissions on or object to the application, In writing, to the Planning Tribunal, within 28 days of the date of publication of this notice. (a) the applicant. (b) Any Minister of the Crown. (c) Any Regional Water Board or regional or united council, or local authority whose region or district Is affected by the application. (d) Any body or person affected by the application. (e) Any body or person representing some relevant aspect of the public interest. MERIVALE RESERVE PROPOSED EXCHANGE OF LAND . PURSUANT to the Reserves Act 1977 public notice is hereby given that It is the Intention of the Christchurch City Council at Its meeting to be held on September 18, 1989 to pass a resolution to enable an exchange of land, which will realign the western boundary of the Merlvale Local Purpose (Landscape) Reserve, located in Papanul Road near Office Road. In exchange for 10 square metres of reserve described In the Schedule hereunder the Council Is to obtain an equivalent parcel of land on the western boundary. SCHEDULE (Canterbury Land District) Area 10 sq m. Being Part Lot 4, D.P. 53609 (Subject to survey). A plan of the reserve that shows the area of the reserve to be affected by the proposal, may be inspected at the Housing and Property Division, Department of City Administration, First Floor, Civic Offices, 163 Tuam Street, Christchurch.
