Goetz may be spared imprisonment

NZPA-AP New York The New York Probation Department has recommended that the subway gunman, Bernhard Goetz, be spared a prison sentence, a defence lawyer said yesterday. Goetz, aged 39, an electronics specialist, was convicted on June 16 of third degree possession of a weapon in connection with the shooting of four youths on a Manhattan subway train in December, 1984. The jury acquitted him on more serious charges, including attempted murder and assault. Goetz is scheduled to be sentenced on October 7 and faces a possible

prison sentence of up to seven years. Mark Baker, one of Goetz’s lawyers, disclosed the sentencing recommendation but declined to elaborate, saying to do so would be inappropriate. A Probation Department spokesman, Gerald Migliore, declined to comment.

It could not be immediately determined whether any other type of sentence was recommended. Goetz said he shot the four youths because they were trying to rob him. The young men, all teenagers at the time, said they were begging for money so they could play video game machines.
