Chamberlains to appeal

By

ROBERT LOWE

NZPA Sydney

Lindy and Michael Chamberlain have applied to have convictions against them quashed in the Northern Territory Court of Criminal Appeal, said a spokesman for the Attorney-General’s Department in Darwin. The Territory’s Government yesterday passed amending legislation that opens the way for the

Chamberlains to appeal to the Court. The Chamberlains’ lawyer wrote to the Attor-ney-General, Mr Darryl Manzie, on Wednesday to say that they wanted to lodge an appeal if the legislattion was passed. The Northern Territory Criminal Code Amendment Act (No. 2), 1987, sets a precedent in Australian law. It allows a convicted person who has been pardoned to ask the

Attorney-General to refer his or her case to the Court to see whether the conviction should be quashed. It also allows the Court to consider evidence presented in a Commission of Inquiry.

Mr Manzie told Parliament that calls for the Government to quash the convictions against the Chamberlains seemed to stand the basic principle of Australian justice on its head.
