Man not a virgin, so his wife sues
NZPA-AP New York A New York woman is seeking to have her marriage annulled on grounds that her husband was sexually active before they wed 18 months ago, but the man has countersued, saying she has been sexually inactive. Susan Ahhalt, aged 22, an orthodox Jew, maintains in court papers that had she known her husband, Henry, aged 25, was not a virgin she would not have married him.
Judge William Rigler granted her the right to a
trial, set for January 12.
The Anhalts were married on July 1, 1985, and separated after 10 weeks.
Mrs Anhalt’s lawyer, Raoul Felder, said English common law held that lying about virginity was a fraud that went to the basis of the marriage. While the principle has been used by men against women, Mr Felder said he could find no precedent that a woman had used it against a man.
