Heathcote sues commission
Court action has been brought by the Heathcote County Council against the Local Government Commission. The council is acting with some Christchurch City residents because it believes the commission acted incorrectly in dealing with a request from those residents to become part of Heathcote County. The commission, after deferring its decision for a while, has declined the request from the 570 City residents of Mount Pleasant and neighbouring areas. Mr Pat Cooney, the Heathcote County Clerk,
said the council did not believe natural justice had been done. “The residents fulfilled their part. We don’t think the commission did its part,” he said. There was a procedure for dealing with such a request under the Local Government Act, he said. The council’s solicitors filed an application in the High Court in Wellington late last week for a judicial review of the commission’s decision. Mr Cooney said the legal action referred only to the commission’s decision on the residents’ request.
